01Agreement to these terms

These Terms of Service are an agreement between you and Accelerate Game Studio. By downloading, installing, accessing or playing any of our games — Elements of Witches & Wizards, Space Station Underworld, War Storm, or Aliens & Zombies Space Wars — or by using this website, you agree to these terms.

If you do not agree with them, do not download or use the games.

02Who can play

You may use our games only if you can form a binding contract with us and are not barred from using them under the laws of your country. Our games are not intended for children under 13, or under 16 where local law sets a higher age.

If you are under the age of majority where you live, you may only use the games with the involvement of a parent or guardian, who must agree to these terms on your behalf.

03Your account

• You need an account to play online. Keep your login details secure and do not share them with anyone.
• One account per person. Accounts may not be bought, sold, transferred, rented or shared.
• Give us accurate information and keep it up to date.
• Tell us promptly if you believe someone else has accessed your account.
• You are responsible for activity that happens on your account, except where it results from our failure to keep the service secure.

04Licence to use the games

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play our games on devices you own or control, for your own non-commercial entertainment.

This is a licence, not a sale of the games. We and our licensors retain all rights in them.

05Virtual items and purchases

Our games may offer virtual currency, items, boosters, passes and other digital content. These are licensed to your account, not sold to you. They have no monetary value, cannot be exchanged for cash, and cannot be transferred between accounts or to another person.

Purchases are processed by Apple's App Store or Google Play, and their payment terms apply. Prices, availability and the contents of offers may change. Except where the law or the store's policy requires otherwise, purchases are final and non-refundable.

We may adjust, remove or rebalance virtual items and game content to keep the game fair and playable. Where we permanently discontinue a paid product you have bought, we will provide a reasonable remedy.

06Acceptable use

When using our games and this website, you must not:

• Cheat, use bots, macros, unauthorised third-party tools, or exploit bugs and design faults for advantage.
• Modify, reverse engineer, decompile, or attempt to extract the source code of our games, except where that restriction is prohibited by law.
• Interfere with servers, networks or security features, or attempt to gain unauthorised access to accounts or systems.
• Harass, threaten, bully, stalk or defame other players, or post hateful, sexually explicit, violent or otherwise objectionable content.
• Impersonate another person, a member of our staff, or the studio.
• Post spam, scams, phishing links, malware or advertising in chat or user-generated content.
• Use the games for commercial purposes, or scrape or harvest data from them.
• Break the law, or encourage anyone else to break it.

07Your content and chat

You keep ownership of anything you create and share in our games, such as your player name, profile picture and chat messages. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and moderate that content so that we can operate and promote the game.

We may remove any content and take action against any account that breaches these terms. We do not pre-screen all chat, but we review reports and act on them.

There is no tolerance for objectionable content or abusive players. You can report content or a player in-game, and reports are reviewed by a human.

08Moderation and enforcement

If you breach these terms we may issue a warning, remove content, reset progress, temporarily suspend your account, or permanently ban it. We may also remove or restrict access to any feature at any time to protect the game or its players.

Serious breaches — cheating, fraud, harassment, or illegal activity — may result in immediate permanent removal without notice. If you believe a decision was wrong, contact us and we will review it.

09Intellectual property

All game content — artwork, characters, worlds, music, text, code, logos and the names Elements of Witches & Wizards, Space Station Underworld, War Storm and Aliens & Zombies Space Wars — is owned by Accelerate Game Studio or its licensors and is protected by intellectual property law.

You may not use our names, logos or artwork in a way that suggests endorsement, or in any commercial product, without our written permission. Streaming and sharing gameplay footage is welcome under our community guidelines.

10Updates, beta features and availability

We update our games regularly, and updates may change, add or remove features. Some features are labelled as beta or preview; they may be unstable, may change without notice, and may be withdrawn.

Online features depend on servers we operate. We may modify or discontinue them, and we will give reasonable notice where we can. We do not guarantee that any online service will be available at all times or free from interruption.

11Third-party platforms

Our games are distributed through the Apple App Store and Google Play. Your use of those stores is governed by their own terms, and you must comply with them. If these terms conflict with a store's mandatory terms, the store's terms apply to the extent of the conflict.

12Apple App Store terms

If you downloaded the game from the Apple App Store, the following also applies. These terms are between you and Accelerate Game Studio only, not Apple. Apple has no obligation to provide maintenance or support for the game. Apple is a third-party beneficiary of these terms and may enforce them against you.

If the game fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the game, including product liability claims, claims that the game fails to conform to legal requirements, and consumer protection or privacy claims.

You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.

13Disclaimers

The games are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the games will be uninterrupted, error-free, or free of harmful components.

Nothing in these terms excludes or limits any warranty or right you have under consumer law that cannot lawfully be excluded.

14Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or virtual items, arising out of or in connection with your use of the games.

Our total liability to you for any claim relating to a game is limited to the greater of the amount you paid us for that game in the twelve months before the claim, or GBP 50. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

15Termination

You may stop using the games and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, or if we discontinue a game entirely.

On termination, your licence to use the games ends. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability and governing law — will continue to apply.

16Governing law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over any dispute, unless a mandatory consumer law in your country of residence gives you the right to bring a claim in your local courts.

Before starting formal proceedings, please contact us so we can try to resolve the issue directly. Nothing here affects your statutory rights as a consumer.

17Changes to these terms

We may update these terms as the games and the law change. If a change is material, we will notify you in the game or by email before it takes effect. Continuing to play after the change takes effect means you accept the updated terms.
